SJCSD utilizes data-based, problem-solving processes to inform multiple tiers of standard-based aligned instruction and intervention. Schools are held responsible for developing a MTSS plan in consultation with the parent\/legal guardian, but parental approval is not required, nor can parents\/legal guardians veto the MTSS process. The school is held accountable for the student\u2019s success and may implement a MTSS plan without a parent\u2019s\/legal guardian\/s approval. Students whose progress monitoring is an IEP, however, must have parent\/legal guardian approval of the plan.<\/p><p>If the parent\/legal guardian refuses to participate in the support strategies detailed in the MTSS plan because he or she believes the strategies are unnecessary or inappropriate, the parent\/legal guardian may appeal to the principal.<\/p><p>The principal shall provide a hearing officer, and the hearing officer shall make a recommendation for final action to the principal. Consistent with school board rules and in accordance with state statute [1012.28 (5) F.S.], the Superintendent has designated the principal of the school as the final authority in the placement of students in programs or classes.
